TERSERV S.A.S. sociedad constituida y existente conforme a las leyes de la República de Colombia, con NIT 900.784.550-8, domiciliada en Bogotá, D.C., con oficinas principales en Bogotá D.C, teléfono +57- 3166976622, es una entidad comprometida con la protección de los datos personales y de toda información que pueda asociarse o relacionarse con personas naturales, determinadas o determinables (los “Datos personales”), a la cual tenga acceso en sus actividades mercantiles. TERSERV recibe, recolecta, utiliza, administra, analiza, segmenta, indexa, transmite, transfiere, almacena y, en general, procesa datos personales tales como los de identificación (nombre, cédula, edad, género, fecha de nacimiento), de contacto (teléfono, correo electrónico, dirección), de visitas e información financiera, de comportamiento del consumidor, entre otros, en calidad de encargado del tratamiento de los datos personales, información que podrá ser obtenida en el curso y para la realización de sus actividades mercantiles.
La presente política de tratamiento de la información de TERSERV (la “Política”) está dirigida a los socios comerciales, proveedores, clientes, trabajadores, colaboradores, contratantes de TERSERV y, en general, a cualquier persona cuyos Datos personales estén siendo o vayan a ser tratados por TERSERV (los “Titulares”). Esta política se aplicará a todo tratamiento de los datos personales realizado dentro del territorio de la República de Colombia por TERSERV y, en lo que corresponda, aquellos terceros con los que TERSERV acuerde todo o parte de la realización de cualquier actividad relacionada con el tratamiento de los datos personales respecto de los cuales TERSERV actúa como responsable de dicho tratamiento.
Tipos de Datos personales.
TERSERV recolecta los siguientes datos personales:
- Nombre, número de documento de identidad, domicilio, teléfono, dirección física o postal, correo electrónico, e información de contacto.
- Nacionalidad, fecha de nacimiento, cédula de ciudadanía, sexo y estado civil.
- Ocupación, empresa donde trabaja, cargo y datos de contacto.
- Información que sea enviada a nosotros o consultada a través de bases de datos de las redes sociales, entre otros medios donde usted haya incluido sus Datos personales.
- Dirección IP y tipo de browser cuando se obtienen por medios electrónicos.
- Información obtenida por cookies, web beaconsy web crawlers.
- Información financiera.
- Cualquier información necesaria para satisfacer solicitudes especiales.
- Información que usted proporciona en relación con sus preferencias comerciales o en el transcurso de la participación en encuestas, concursos u ofertas promocionales.
- Imágenes, fotografías y huellas digitales.
- Datos personales que se consideran de carácter sensible.
Tratamiento y Finalidades.
TERSERV, en el curso de sus actividades mercantiles, recolectará, utilizará, administrará, almacenará, analizará, anonimizará, indexará, segmentará, realizará perfiles, transmitirá, transferirá y realizará diversas operaciones con los Datos personales. Los datos personales procesados por TERSERV deberán someterse únicamente a las finalidades que se señalan a continuación o las que sean aceptadas por los titulares en el momento de la recolección de los datos personales. Asi mismo, los encargados o terceros que tengan acceso a los datos personales en virtud de la ley, contrato u otro documento vinculante, realizarán el tratamiento para la consecución de las siguientes finalidades:
Para clientes: (a) la creación de la cuenta personal en la página web de TERSERV, (b) el procesamiento de órdenes y pedidos en línea, (c) el envío de mensajes promocionales, catálogos y boletines, (d) contacto con el cliente en el caso de cualquier situación con la entrega de su pedido, (e) la notificación de ganadores de promociones online, (f) el manejo de la cuenta de la página de TERSERV, (g) la realización de promociones y mercadeo dirigido específicamente a los clientes, (h) la validación de la mayoría de edad, (i) cumplir las obligaciones tributarias, contractuales y legales; (j) evaluar y clasificar clientes y clientes y proveedores, (j) proteger los derechos de TERSERV, conforme a las disposiciones legales, (k) completar transacciones, obtener datos de facturación y emitir facturas, (l) llevar a cabo análisis estadístico de los datos recolectados para optimizar el funcionamiento del servicio prestado, (m) personalizar la página web y/o aplicaciones para teléfonos móviles de acuerdo a los gustos e intereses de los Titulares y (n) compartir la información a través de redes sociales y páginas de internet.
Para empleados: (a) la administración del recurso humano de TERSERV, incluyendo, pero sin limitarse a, la evaluación de los candidatos interesados en ser empleados de TERSERV, la vinculación laboral a TERSERV, procesos de capacitación, realización de evaluación del desempeño, adelantar programas de bienestar social y salud ocupacional, expedición de certificaciones laborales, (b) la gestión de bancos de hojas de vida y jornadas de reclutamiento para contratación de personal.
Para proveedores y contratistas: (a) cumplir con los procesos internos de TERSERV en materia de administración de proveedores y contratistas.
Condiciones generales: (a) gestionar toda la información necesaria para el cumplimiento de las obligaciones tributarias y de registros comerciales, corporativos y contables de TERSERV y de sus clientes, (b) el proceso de archivo, de actualización de sistemas, de protección y de custodia de información y bases de datos, (c) adelantar campañas de actualización de datos personales para garantizar la integridad de los mismos, (d) adelantar investigaciones internas de conformidad con las diferentes políticas de la empresa en caso de actividades sospechosas que puedan afectar el buen nombre de TERSERV, (e) el envío de las modificaciones a esta política, así como la solicitud de nuevas autorizaciones para el tratamiento de los datos personales, (f) transmitir datos personales a terceros con los cuales se hayan celebrado contratos con este objeto o se hayan suscrito documentos, tales como otrosíes o declaraciones, que permitan transmitir los datos personales, para fines comerciales, administrativos y/u operativos, (g) para dar cumplimiento a los fines mencionados anteriormente, a transferir, transmitir, trasladar, compartir, entregar, y/o revelar datos personales a terceros, dentro y fuera del territorio nacional, incluso a países que no proporcionen niveles adecuados de protección de datos personales.
Derechos de los Titulares.
De acuerdo con la ley, los Titulares tienen los siguientes derechos:
Actualización: Actualizar los datos personales que reposen en las bases de datos de TERSERV para mantener su integridad y veracidad.
Conocimiento y acceso: Conocer y acceder a sus datos personales almacenados por TERSERV o los encargados. Este acceso se permitirá de forma gratuita según solicitud al menos una vez al mes.
Prueba: Solicitar prueba de la autorización otorgada a TERSERV, salvo que la ley indique que dicha autorización no es necesaria o que la misma haya sido validada con arreglo a lo establecido en el Decreto 1074 de 2015.
Queja: Presentar ante la Superintendencia de Industria y Comercio quejas por infracciones a la ley cuando se haya agotado el requisito de procedibilidad y acudir en primera instancia a TERSERV.
Rectificación: Rectificar la información y los datos personales que estén bajo el control de TERSERV.
Revocación: Solicitar la revocatoria de la autorización, siempre y cuando no exista un deber legal o una obligación de carácter contractual en cabeza del titular con TERSERV, según la cual el titular no tenga el derecho de solicitar la supresión de sus datos personales.
Solicitud: Presentar solicitudes ante TERSERV o el encargado respecto del uso que les han dado a sus datos personales.
Supresión: Solicitar la supresión de sus datos personales de las bases de datos de TERSERV, siempre y cuando no exista un deber legal o una obligación de carácter contractual en cabeza del Titular con TERSERV, según la cual el titular no tenga el derecho de solicitar la supresión de sus datos personales.
Los titulares podrán ejercer sus derechos de ley y realizar los procedimientos establecidos en esta política contactando a la compañía a través del correo electrónico info@pachocorrales.com. TERSERV se encargará de responder las quejas, solicitudes o reclamos con arreglo a lo dispuesto en las normas colombianas de protección de Datos personales y dentro de los términos allí establecidos.
Procedimiento para ejercicio de derechos por los titulares.
Para el ejercicio de sus derechos a conocer, actualizar, rectificar y suprimir los datos personales almacenados en las bases de datos de TERSERV y revocar la autorización de uso y almacenamiento de dicha información personal, el titular de los datos personales debe dirigir la solicitud o reclamo respectivo por escrito a la información de contacto del área encargada de datos personales.
Dicha solicitud o reclamo será objeto de respuesta por escrito dentro de los diez (10) días hábiles siguientes a su efectiva notificación a TERSERV. Dicho término de respuesta podrá ser prorrogado por un periodo igual antes del vencimiento del término inicial.
En caso de que la solicitud o reclamo relacionado con los datos personales guarde relación con varias bases de datos, el titular deberá dirigir dicha solicitud al área encargada de datos personales.
Consulta: El titular de la información podrá consultar de forma gratuita sus datos personales al menos una vez cada mes calendario. Para conocer los datos personales que son objeto de tratamiento por parte de TERSERV, el titular de información podrá elevar una solicitud por escrito indicando la información que desea conocer a través de cualquiera de los mecanismos arriba señalados.
La petición será atendida por escrito en un término máximo de diez (10) días hábiles contados a partir de la fecha de recibo de la misma. Cuando no fuere posible atender la petición dentro de dicho término, este hecho se informará al solicitante por escrito, expresando los motivos de la demora y señalando la fecha en que se atenderá su consulta, la cual en ningún caso podrá superar los cinco (5) días hábiles siguientes al vencimiento del primer término.
Reclamos: De conformidad con lo establecido en el artículo 14 de la Ley 1581 de 2012, cuando el titular o sus causahabientes consideren que la información contenida en una base de datos debe ser objeto de corrección, actualización o supresión, o cuando deba ser revocada por advertirse el presunto incumplimiento de cualquiera de los deberes contenidos en la Ley 1581 de 2012, podrán presentar un reclamo por escrito ante TERSERV, el cual será tramitado bajo las siguientes reglas:
Los derechos de rectificación, actualización o supresión o revocatoria del consentimiento únicamente se podrán ejercer por:
- El titular o sus causahabientes, previa acreditación de su identidad.
- Su representante, previa acreditación de la representación.
- Por estipulación a favor de otro o para otro.
Cuando la solicitud sea formulada por persona distinta del titular y no se acredite que la misma actúa en representación de aquél, se tendrá por no presentada. La solicitud de rectificación, actualización, supresión o revocatoria debe ser presentada por escrito a través de los medios habilitados por TERSERV y contener, como mínimo, la siguiente información:
- El nombre y domicilio del titular o cualquier otro medio para recibir la respuesta.
- Los documentos que acrediten la identidad del solicitante y en caso dado, la de su representante con la respectiva autorización.
- La descripción clara y precisa de los datos personales respecto de los cuales el titular busca ejercer alguno de los derechos y la solicitud concreta.
- En caso dado otros elementos o documentos que faciliten la localización de los datos personales.
- El término máximo para atender por escrito el reclamo será de quince (15) días hábiles contados a partir del día siguiente a la fecha de su recibo. Cuando no fuere posible atender el reclamo dentro de dicho término, se informará al interesado los motivos de la demora y la fecha en que se atenderá su reclamo, la cual en ningún caso podrá superar los ocho (8) días hábiles siguientes al vencimiento del primer término.
- Dicha solicitud o reclamo será objeto de respuesta dentro de los diez (10) días hábiles siguientes a su efectiva notificación. Dicho término de respuesta podrá ser prorrogado por un periodo igual antes del vencimiento del término inicial.
- En caso de que la solicitud o reclamo relacionado con el tratamiento, privacidad y protección de Datos personales guarde relación con varias bases de datos, el Titular deberá dirigir dicha solicitud o reclamo a área encargada de Datos personales.

La dependencia de TERSERV encargada de la recepción y atención de Peticiones, Quejas y Reclamos relacionados con Datos personales puede ser contactada en info@pachocorrales.com.
Vigencia.
Esta política empezará a regir a partir del 1 de enero de 2018. Los datos personales que sean almacenados, utilizados o transmitidos permanecerán en la base de datos de TERSERV, con base en el criterio de temporalidad, durante el tiempo que sea necesario para las cumplir con las finalidades mencionadas en esta política, para las cuales fueron recolectados. De este modo, la vigencia de la base de datos está estrechamente relacionada con las finalidades para las cuales fueron recolectados los datos personales.
Modificaciones.
Esta Política podrá ser modificada de tiempo en tiempo por TERSERV y hará parte de los contratos que celebre TERSERV, donde resulte pertinente. Toda modificación sustancial de esta política tendrá que ser comunicada previamente a los Titulares por medio de mecanismos eficientes, tales como la página web de TERSERV y/o correos electrónicos. De ser requerido por la legislación aplicable, también se buscará obtener la autorización de los titulares. Por modificaciones sustanciales se entienden, entre otras, las relacionadas con el ejercicio de los derechos de los Titulares y con las finalidades del tratamiento de datos personales cuando ello pueda afectar la autorización.
